Article 3 – Scope of Application
These Terms and Conditions apply to every offer made by us and every contract concluded between us and a consumer through the website.
Before completing an order, you will be given the opportunity to review these Terms and Conditions. They will also be made available in a format that allows you to save or print them.
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to remain in full force and effect.
Nothing in these Terms and Conditions affects your statutory rights as a consumer.
Article 4 – Products, Prices and Offers
We take reasonable care to ensure that all product descriptions, prices and other information displayed on our website are accurate.
However, minor differences in colour, texture, appearance or finish may occur because of photography, lighting, screen settings or manufacturing variations.
Product images are provided for illustrative purposes. Your product may vary slightly from the images shown, provided that it remains consistent with the product description.
Obvious typographical, pricing or technical errors are not binding. Where an error affects your order, we will contact you and give you the option to continue at the correct price or cancel the order for a full refund.
Unless otherwise stated, prices are displayed in pounds sterling.
Any applicable delivery charges, taxes or other charges payable to us will be clearly displayed before you complete your purchase.
We may change product prices and availability at any time, but changes will not affect an order that we have already accepted.
Article 5 – Orders and Formation of the Contract
By placing an order, you confirm that:
-
The information you provide is complete and accurate.
-
You are authorised to use the selected payment method.
-
You are legally capable of entering into a binding contract.
After placing an order, you may receive an automatic acknowledgement confirming that we have received it. This acknowledgement does not necessarily mean that your order has been accepted.
A binding contract is formed when we send you confirmation that your order has been accepted or dispatched.
We reserve the right to refuse or cancel an order where:
-
A product is unavailable.
-
Payment cannot be authorised.
-
Incorrect information has been provided.
-
We reasonably suspect fraud or unauthorised activity.
-
A pricing or product description error has occurred.
-
The order breaches these Terms and Conditions.
Where we cancel an order after payment has been taken, we will issue a refund using the original payment method.
Article 6 – Right to Cancel and 30-Day Returns
Consumers purchasing products online generally have the right to cancel an eligible order without giving a reason.
The statutory cancellation period ends 14 days after the day on which you, or a person nominated by you, receives the products.
To exercise your right to cancel, you must clearly inform us of your decision by contacting:
Email: support@elvorathelabel.com
After notifying us of your cancellation, you must return the products within 14 days.
In addition to your statutory rights, we voluntarily offer a 30-day return period, beginning on the day your order is delivered, unless an exclusion stated in these Terms and Conditions or our Returns Policy applies.
Products returned under our voluntary return policy must be:
-
Unworn and unused, except where reasonably necessary to inspect them.
-
In their original condition.
-
Free from damage, marks, scents or signs of wear.
-
Returned with original tags attached.
-
Returned in the original packaging where reasonably possible.
We may reduce a refund where products have lost value because they have been handled beyond what would reasonably be permitted when examining them in a physical shop.
Our voluntary 30-day return policy does not limit or replace your statutory consumer rights.
Article 7 – Return Costs and Refunds
You will normally be responsible for the direct cost of returning products where you:
-
Cancel because you have changed your mind.
-
Return a product under our voluntary 30-day return policy.
-
Ordered the incorrect size, colour or product.
We will cover reasonable return costs where a product is faulty, damaged upon arrival, incorrectly supplied or not as described.
Where you exercise your statutory right to cancel, we will refund the amount paid for the returned products and the cost of our least expensive standard delivery option.
Any additional amount paid for express, premium or upgraded delivery will not normally be refunded beyond the cost of standard delivery.
Refunds will be made using the original payment method unless you expressly agree otherwise.
We may withhold the refund until we have received the returned products or until you provide evidence that they have been sent back, whichever occurs first.
Refunds will be processed without undue delay and no later than 14 days after we receive the returned products or acceptable proof of return.
Your bank or payment provider may require additional time to credit the refund to your account.
Article 8 – Exclusions from the Right to Cancel
The right to cancel may not apply to:
-
Products made to your specifications.
-
Clearly personalised or customised products.
-
Products that deteriorate or expire rapidly.
-
Sealed products that are not suitable for return for health protection or hygiene reasons once unsealed.
-
Products that have become inseparably mixed with other items after delivery.
-
Any other products legally excluded from cancellation rights.
Any applicable exclusion will be clearly communicated before purchase where required.
These exclusions do not affect your rights where a product is faulty, damaged, incorrectly supplied or not as described.
Article 9 – Delivery and Performance
Delivery times displayed on our website are estimates unless we expressly agree to deliver by a specific date.
Unless a different delivery period has been agreed, we will deliver your order without undue delay and normally within 30 days of the contract being formed.
Delivery may occasionally be affected by circumstances outside our reasonable control, including severe weather, carrier disruption, customs inspections, public emergencies or other events beyond our control.
Where a delay occurs, we will take reasonable steps to keep you informed.
You are responsible for providing a complete and accurate delivery address. We are not responsible for delays or failed deliveries caused by incorrect or incomplete information supplied by you.
Products remain at our risk until they come into your physical possession or the physical possession of a person identified by you to receive them.
Where you independently arrange delivery using a carrier that we did not offer as a delivery option, risk may transfer when the products are handed to that carrier.
Nothing in this section limits your statutory rights where an order is not delivered within an agreed or legally required period.
Article 10 – Product Conformity and Consumer Rights
We are under a legal duty to supply products that conform to the contract.
Products must be:
-
Of satisfactory quality.
-
Fit for their usual purpose and any particular purpose made known to us before purchase.
-
As described.
-
Consistent with any sample or model shown, where applicable.
Where a product does not meet these requirements, you may be entitled to legal remedies including rejection, repair, replacement, a price reduction or a refund, depending on the circumstances.
Nothing in these Terms and Conditions excludes or restricts rights provided under the Consumer Rights Act 2015 or other applicable consumer protection legislation.
Article 11 – Limitation of Liability
Nothing in these Terms and Conditions excludes or limits liability for:
-
Death or personal injury caused by negligence.
-
Fraud or fraudulent misrepresentation.
-
Breach of your statutory consumer rights.
-
Any matter for which liability cannot legally be excluded or limited.
We are responsible for losses that are a foreseeable result of our breach of these Terms and Conditions or our failure to use reasonable care and skill.
A loss is foreseeable where it was an obvious consequence of our breach or where both you and we knew that it might occur when the contract was formed.
We are not responsible for losses that were not reasonably foreseeable.
Our products are supplied for private and domestic use. Unless expressly agreed otherwise, we are not responsible for business losses, including loss of profit, revenue, business opportunity, anticipated savings or business interruption.
Article 12 – Complaints
Complaints should be submitted within a reasonable time after you discover the issue.
Please include your name, order number and a clear explanation of the problem so that we can investigate it efficiently.
Complaints can be submitted to:
Email: support@elvorathelabel.com
We aim to acknowledge customer enquiries within 24 hours and provide a substantive response to formal complaints within 14 days.
Nothing in this complaints procedure prevents you from exercising your statutory rights or seeking assistance from an appropriate consumer protection or dispute-resolution service.
Article 13 – Governing Law and Jurisdiction
These Terms and Conditions and any contract between you and us are governed by the laws of England and Wales.
The courts of England and Wales will generally have jurisdiction over disputes arising from these Terms and Conditions.
If you live in Scotland or Northern Ireland, you may also bring legal proceedings in the courts of the part of the United Kingdom in which you live.
Nothing in this section deprives you of any mandatory consumer protection rights that apply in your place of residence.
Article 14 – Changes to These Terms
We may update these Terms and Conditions occasionally to reflect changes to our services, business practices or applicable laws.
The updated version will be published on this page with a revised “Last updated” date.
Changes will not normally affect orders placed before the updated Terms and Conditions were published unless required by law.
